Terms of Service

These Terms of Service ("Terms") are a binding contract between you and Group Home Listing Marketplace ("Group Home Listing", "we", "us", "our") governing your access to and use of the website at grouphomelisting.com, our mobile applications, and related services (the "Platform"). By creating an account or using the Platform you agree to these Terms, our Privacy Policy, and, depending on your role, our Family & Guest Terms or Operator Terms of Business. Where those role-specific terms conflict with these Terms, the role-specific terms control for that subject matter.

The Platform is an online marketplace and communications service. We do not own, operate, license, staff, supervise, or insure any group home listed on the Platform. Operators are independent third parties. We are not a healthcare provider, residential care provider, placement agency in a fiduciary capacity, broker, or insurer.

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information you provide and for maintaining the security of your account and password. Notify us immediately of any unauthorized access.

You agree not to:

• violate any law or third-party right;
• post false, misleading, defamatory, harassing, or discriminatory content, or content that infringes intellectual property;
• impersonate any person or entity, or misrepresent your affiliation with any home, operator, or agency;
• scrape, crawl, reverse engineer, or use the Platform to build a competing dataset or service;
• attempt to circumvent commissions, security controls, verification, rate limits, or moderation;
• upload malware, engage in fraud, launder funds, or facilitate trafficking or abuse;
• transmit protected health information beyond what is necessary for a placement inquiry, or personal information you are not authorized to share.

You retain ownership of the content you submit (listings, photos, videos, reviews, messages). You grant us a worldwide, royalty-free, sublicensable, transferable license to host, display, reproduce, adapt, translate, and distribute that content for the purpose of operating and promoting the Platform. You represent you have all rights necessary to grant this license, including consents from anyone depicted or identifiable in your content.

Payments made through the Platform are processed by Stripe, Inc. and its affiliates under Stripe's own terms and privacy policy. We do not store full card numbers or bank credentials. We may collect commissions, deduct fees, hold funds, reverse or refund payments, and offset amounts owed, as further described in the applicable role-specific terms.

The Platform integrates with third-party services (for example Stripe for payments, mapping providers, analytics providers, email delivery providers). We are not responsible for third-party services and your use of them is governed by their own terms.

The Platform, including software, brand marks, "Group Home Listing", the logo, "EliteOperator", "Become a Group Home Operator", and all trade dress, are owned by us or our licensors. You may not use our marks without our prior written permission.

We may suspend or terminate your access at any time and for any reason, including violation of these Terms, suspected fraud, abusive behavior, or risk to families or Operators. Sections that by their nature should survive termination (including license, disclaimers, limitation of liability, indemnity, and dispute resolution) will survive.

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that any Operator or home is licensed, safe, appropriate, or suitable.

To the maximum extent permitted by law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or care outcomes. Our aggregate liability arising out of or relating to the Platform will not exceed the greater of (a) US $100 or (b) the amounts you paid us in the twelve months preceding the event giving rise to the claim.

You will indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Platform, your content, your interactions with Operators or families, or your breach of these Terms or applicable law.

Any dispute arising out of or relating to these Terms or the Platform will be resolved by final and binding individual arbitration administered by the American Arbitration Association, seated in Delaware. You and we each waive any right to a jury trial and any right to participate in a class, collective, or representative action. Either party may seek injunctive relief in court to protect intellectual property or confidential information.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

We may update these Terms from time to time. Material changes will be posted with a new effective date. Continued use after the effective date constitutes acceptance.
